Fraud Section

The Civil Division's Commercial Litigation Branch (Fraud Section), working with U.S. Attorneys Offices around the country, litigates cases involving financial fraud against the federal government. Our greatest caseload concerns fraud against healthcare programs - primarily Medicare and Medicaid, but also other federal health care programs. We also handle many cases involving fraud in the procurement of weapons systems and other goods and services by the Department of Defense. But we also have a diverse practice which addresses all types of fraud against all federal agencies including such areas as research grants, subsidy programs, construction of federal buildings, purchases of Government equipment and information technology, and foreign aid. We are, in effect, the outside fraud litigation counsel to all agencies of the federal government. A significant part of our practice includes not just litigating cases but also investigating fraud allegations, and in these efforts we work closely with the Criminal Division and the Offices of the United States Attorneys, the Federal Bureau of Investigation, and the Offices of Inspector General of our client agencies. Typically, we file fraud suits under the False Claims Act, a federal statute enacted during the Civil War in response to defense contractor fraud even back then; however, some of our litigation involves other causes of action including illegal kickbacks, conflicts of interest, and bribery. The False Claims Act also allows private citizens to file suits on behalf of the Government (called "qui tam" suits) against those who have defrauded the Government and receive a share of the Governments recovery. Many of our investigations and lawsuits arise from such qui tam actions.
